Analyzes the compliance of the law in Montenegro with the EU regulation Law on Freedom of Media and Law on Digital Services – Description of conditions and tasks for bidders (ToR)
- Backgound
The project “Professional journalism for better protection of human rights” is implemented by the Media Center in partnership with the Montenegro Media Institute and the Center for Investigative Journalism of Montenegro. The project is financed by the European Union and Ministry of public administration.
Overall objctive of the project:
Strengthening the role of journalists and civil society in the protection and promotion of human rights, democracy and good governance in Montenegro
Specific objective of the project:
Improved capacities of journalists and citizens to perform control functions in society, act against misinformation and disinformation in the media and meet professional standards.
- SUBJECT OF PROCUREMENT
Preparation of draft Analysis with recommendations for changes and additions of Montenegrin regulations. After drafting the first version of the Analysis, the consultant will hold an online meeting with a working group consisting of representatives of the Ministry of Culture and Media, the Agency for Audiovisual Media Services, the Agency for Electronic Communications and Postal Services, project partners and CSOs active in the field of media.
After the meeting, the consultant will prepare an updated version of the analysis. The Analysis will contain clear conclusions that should be drawn up in order to ensure greater independence of the media in their work, reduce pressure on journalists, reduce the spread of misinformation and hate speech, and improve the professionalism of the media. On the basis of the Analysis, a concrete initiative for amending the law will be made, which will be submitted to the competent state bodies and members of parliament. As part of the Analysis, the consultant should propose concrete legal solutions that will harmonize the regulations in Montenegro with the Media Freedom Act and Digital Service Act.

- RESPONSIBILITIES AND TASKS OF THE EXPERT
The main deliverables of the expert will include expected deliverables which are:
• Develop a methodology for the preparation of a Analyzes the compliance of the law in Montenegro with the EU regulation Law on Freedom of Media and Law on Digital Services.
• Develop a draft and final version of the Analyzes the compliance of the law in Montenegro with the EU regulation Law on Freedom of Media and Law on Digital Services.
In order to produce desired deliverables, the expert will:
1. Closely cooperate with relevant representatives of the Contractor;
2. Conduct desk study of necessary documents;
3. Develop instruments to be used during the process of data gathering and developing the documents;
4. For the purpose of developing the documents, design and organize multistakeholder participatory process including:
and. Set of meetings and interviews with relevant stakeholders based on the approach agreed upon with the representatives of the Contractor;
5. Produce the initial structure of the documents;
6. Produce draft and final version of the expected deliverable.
- PROFESIONAL REQUIREMENTS
- 5 years of working experience in analysis of the media and public information environment in Montenegro and/or the countries in the Western Balkan region and EU countries
- 5 years of working experience with government institutions, media and civil society
- At least contributed to the development of 5 reports related to policy, law or media environment development
- EU experience in the development of the media environment will be regarded as an asse

- CRITERIA AND METHOD OF SELECTING CANDIDATES
Criterion for evaluation of offers:
– References (previous experience and doing similar tasks)-70%
– Price-30%
Unsuccessful/successful bidders will be informed in writing about the results of the evaluation process.
The estimated response time to bidders is 10 days from the deadline for submitting bids.
The project team reserves the right to contact each bidder to verify the information provided. A written report on the selection of the contractor will be delivered to all candidates who apply for the competition.
Conflict of interest: Natural or legal persons who are in a potential conflict of interest, or persons who can in any way influence the process of objective decision-making, cannot apply for this call. The Commission and the project team reserve the right to reject an application that is found to be in a potential conflict of interest in accordance with domestic legislation and European Union rules.
